Fee Schedule

Review a detailed listing of the fees charged by the New Castle County Sheriff's Office. Do not send cash or personal checks. The NCC Sheriff's Office no longer accepts cash. Acceptable forms of payment: checks from law firms, money orders, or cashier's checks made payable to the Sheriff of New Castle County. A $35 fee will be assessed for all returned checks, in addition to any banks fees or charges.

Out-of-Country Court Writs $90
$90 per case per address. $5 additional fee for each writ at the same address. Send one copy of what you want served with a cover letter describing your request. Also include a self-addressed, large pre-paid envelope for return of service affidavit.
Out-of-State Court Writs $75 $75 per case, per address, per registered agent. $5 Additional fee for each writ at same address. Send one copy of what you want served with a cover letter describing your request. Also include a self-addressed, large pre-paid envelope for return of service affidavit. 
Real Estate Deposit
$355 Deposit due at the time of filing to cover advertising, set-up costs and auctioneer fee. This includes the Sheriff's $150 set-up fee which is charged for all properties scheduled for sheriff sale.
Real Estate Purchase Deposit (Mortgage Foreclosure & Vend. Exp. Judgment Sales) 10% Purchase deposits shall be ten (10) percent on a mortgage foreclosure and Vend Exp. Judgment sale, and shall be non-refundable, unless otherwise ordered by the Court.
Real Estate Purchase Deposit (Monition Sale) 100% Purchase deposit shall be the full amount of the high bid at the time of a monition sale, and shall be non-refundable, unless otherwise ordered by the Court.
Real Estate Sale Commission Fee 4% Four (4) percent of the total selling price, including costs, except that the total amount paid under this subsection shall not exceed ten thousand dollars ($10,000.00) and shall not be less than five hundred dollars ($500.00).
Forfeit of Deposit $500 The Sheriff’s Office will retain five hundred dollars ($500.00) of any deposit that is forfeited under court order.
Rule to Show Cause $30
